Berry Nova Privacy Policy

Berry Nova (operated by S&W Island Group LLC) provides an AI platform that lets a coach, consultant, or expert train a personal AI on their own knowledge and content, to support their clients and community. This policy explains what data we collect and how we handle it.
1) Information we collect
We collect information you give us directly -- your name, email, billing information (payments are processed by Stripe), and the content you upload to train your AI. We also automatically collect some technical information when you use our services, such as IP address and basic usage data.
2) How we use it
We use this information to provide and improve our services, process payments, communicate with you about your account, and meet our legal obligations.
3) Who we share it with
We do not sell your personal information. We share it with service providers who process it on our behalf to run Berry Nova, including: AI model providers (such as OpenAI, Anthropic and Google); payment processing (Stripe); our application, database and file storage, run by us and our development contractor; email (Google Workspace, Mailjet); website hosting, analytics and security (Lovable, Cloudflare); and, if you connect them, messaging and integration channels such as WhatsApp, Instagram, Telegram and Google Drive. This list may change as we add or replace providers. These providers are contractually required to protect your data.
4) Content ownership
The content you upload remains your property. We don't claim ownership of it. We use it to operate, secure, support and improve Berry Nova -- including adjusting the instructions your AI follows based on how it performs -- and we don't use it to train AI models.
5) Data about your clients and leads
Most of the personal data Berry Nova handles belongs to the people who talk to your AI -- your clients and leads, not just you. For that data, we act on your instructions as the coach or expert who set up the AI; you're responsible for telling your own clients how their data is used and getting any consent the law requires. If someone who has talked to your AI wants to exercise a privacy right, they should contact you first -- we'll help you respond.
6) Data retention and deletion
We keep your data while you have an account with us. After you cancel, we keep it until you ask us to delete it -- we don't currently delete it automatically. To ask for deletion, email support@berrynova.ai from the email address on your account, so we can confirm it's really you. We'll respond within one month, and longer for complex requests, in which case we'll tell you why. We'll delete or anonymize your data in our own active systems; copies may remain for a limited time in backups, logs, and with our service providers until they expire on their own schedules, and we keep records the law requires us to keep, such as billing records.
7) Your requests -- access, correction, export, deletion
You can ask us to access, correct, export or delete your personal data at any time by emailing support@berrynova.ai from the email address on your account, so we can confirm the request is really from you. We don't yet have a self-serve tool for this, so requests are handled by our team; we'll respond within one month, and longer for complex requests, in which case we'll tell you why.
8) Data protection rights
Berry Nova (S&W Island Group LLC) is the controller of the personal data described in this policy. We process it to provide the service you've asked for, to meet our legal obligations, and for our legitimate business interests, such as keeping the service secure and improving it. Our service providers are mainly based in the United States, so your data is processed there and in other countries where they operate.
If data protection law where you live gives you rights over your personal data -- for example to access, correct, delete, or receive a copy of it -- you can use them as described in section 7. You can also complain to your local data protection authority at any time.
9) Security
We take reasonable steps to protect your data, such as encrypted connections. No system is completely secure, and we can't guarantee absolute security.

11) Children
Our services aren't directed at anyone under 16, and we don't knowingly collect their data. If your clients include anyone under 18, see the responsibility clause in our Terms of Service.
12) Changes to this policy
We may update this policy as the product changes. This version is effective September 17, 2026; if we make a significant change, we'll let active customers know.
