Berry Nova Terms of Service

1) About Berry Nova
Berry Nova is an AI platform, operated by S&W Island Group LLC, that lets a coach, consultant, or expert train a personal AI on their own knowledge and content, so it can support their clients and community. By using our services, you agree to these terms.
2) Your account
You need an account to use most of our services. You're responsible for keeping your login details secure and for activity on your account. Tell us right away if you think someone else has access to it.
3) Acceptable use
Use Berry Nova lawfully and don't try to damage, overload, or gain unauthorized access to our systems, or use it to transmit illegal or infringing material. You confirm you have the right to upload the content you use to train your AI, including any recordings or information about other people, and that you'll give them any notice or get any consent the law requires. Don't use Berry Nova to handle protected health information, or as a substitute for licensed medical, legal, or financial advice.
4) Your content
You keep all rights to the content you upload. As between you and Berry Nova, any rights we may have in the AI output your account generates belong to you too, to the extent the law allows -- though similar output could be generated for someone else, and we don't guarantee it's free of third-party rights. You give us permission to use, store and process your content to operate, secure, support and improve Berry Nova; we don't use it to train AI models.
5) AI output and your responsibility
Berry Nova's AI can make mistakes. You're responsible for reviewing what it tells your clients -- it isn't a substitute for your own professional judgment, or for licensed medical, legal, or financial advice. You're responsible for what your AI is trained on and for what it says to your clients, and you agree to cover us for claims arising from content you provided or how you used the service, except where caused by our own breach of these terms. If your clients include anyone under 18, you're responsible for getting any consent the law requires before their information is submitted to Berry Nova. We may suspend or end an account that breaches these terms or puts the service or other customers at risk.
6) Payments, billing, and cancellation
Paid plans renew automatically until cancelled. Every plan comes with a 30-day guarantee: a full refund, no questions asked, counted from your first payment. Email hello@berrynova.ai from the address you signed up with. An unused credit pack bought within those 30 days is refunded too. Some purchases, such as the Founding Program, may include additional or different guarantee terms, set out separately when you buy. Prices may change with notice.
What each plan includes, and its credit or usage limits, are described on the pricing page. If you reach your plan's limit, the AI may stop responding until it resets or you upgrade. We don't guarantee the service will be available without interruption or free of errors.
7) Our liability
To the extent the law allows, we aren't liable for indirect or consequential damages from using our services, and our total liability is limited to the greater of what you've paid us in the 12 months before the claim, or USD 100.
8) Governing law
These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules, and any dispute will be resolved in the state or federal courts located in Wyoming.
9) Changes
We may update the service or these terms as the product evolves. This version is effective September 17, 2026; if we make a significant change, we'll let active customers know.
